The Nominal Defendant is a statutory body established under the Motor Accident Insurance Act 1994 (MAI Act) for the purpose of compensating people who are injured as a result of the negligent driving of unidentified and/or uninsured (no Compulsory Third Party (CTP) insurance) motor vehicles. The Nominal Defendant has the right to recover as a debt, the amount paid in settlement of the claim, from the owner or driver (or both) of the uninsured motor vehicle.
The purpose of this Invitation to Offer is to establish a Standing Offer Arrangement (SOA) with three (3) suitably qualified legal firms that will provide legal services for the Nominal Defendant in relation to CTP claims in Queensland. Legal firms must propose one or more Panel Lawyers, one of whom must be the designated the Relationship Manager for the SOA.
Depending on requirements these goods / services specifically include:
Undertaking legal work on behalf of the Nominal Defendant and providing legal advice to the Nominal Defendant on the management of potential recovery actions
The delivery of pro-active and cost-effective claims management strategies
Providing training and education to the Nominal Defendant as and when required, and
Examining and providing advice on any CTP scheme significant matters as and when requested.
