Technical Competency Assessment

The demand for this service is critical in ensuring the department meets its obligations under section 572(b)(i) of the EP Act, to asses if the applicant has the qualifications and experience relevant to perform the functions of an auditor. This includes deciding on an application within 30 business days of receiving it under the amended EP Act.
The requirement for the service is required for a minimum of 3 years.
In the past EHP had an internal panel to assess the competencies of applicants to be Third Party Reviewers (TPRs) under the Procedural Guide “Contaminated Land – Third Party Reviewer terms of reference”,  consistent with the standards suggested by the National Environment Protection (Assessment of Site Contamination) Measure 1999.  While EHP has the technical capability to fulfil this role it does not commonly have the resourcing to meet Statutory timeframes. 
Machinery-of-Government (MOG) changes in 2012 resulted in a shift in strategic focus through the development of EHP’s Regulatory Strategy, moving EHP’s client focus away from departmental assessment, and towards streamlined approvals, an increased use of certification by third parties and increased monitoring and targeted compliance.
In-line with the Regulatory Strategy and the Greentape Reduction Act amendments in 2013, the Environmental Performance and Co-ordination Branch (EPC) implemented a framework to allow the certification of third party contaminated land auditors in accordance with Chapter 12 Part 3A of the EP Act to perform evaluations of site investigation reports; validation reports; draft site management plans; and draft amendments of site management plans for contaminated land; prepared under Chapter 7, Part 8 of the EP Act.
From the 1st July 2014, amendments to Chapter 12 Part 3A of the EP Act make it compulsory for development applications (DA) triggered under the Sustainable Planning Act 2009 (SP Act) to engage certified contaminated land auditors to assess development applications. In addition, there is also EP Act amendments proposed that will make it compulsory for all contaminated land reports to be certified by approved auditors.
