Tender Overview

WorkCover Queensland (WorkCover) invites Suppliers to submit an offer to SOA Invitation to Offer No. WCQ314 for the provision of Common Law Claims Management Services as specified in the Part B – SOA Details document. This is an open market tender.

WorkCover has issued this Invitation to Offer with the objectives of:

  • Establishing a panel of providers under an SOA commencing 1 July 2023 with an initial term of 3 years and the possibility to extend for 2 further periods of up to 1 year each at the discretion of WorkCover
  • Engaging a panel of common law claims management service providers who are suitable to work in partnership with WorkCover in line with its values to provide high quality services to manage a portfolio of common law claims and have the option of providing other corporate legal services to WorkCover on an ad hoc basis
  • Injecting innovation and partnering into the way common law claims are managed within WorkCover to assist the organisation to meet its objectives
  • Undertake a competitive, fair, and ethical procurement process in line with all procurement policy recommendations.

The scope of the services for the SOA includes, but is not limited to the following:

  • Managing the resolution of a portfolio of common law claims including the following activities:
    • Pre-proceedings, litigation proceedings and trial proceedings for all common law claim types.
    • Delivery of services to Brisbane and regional areas.
    • Ensuring there is on-going stakeholder engagement with WorkCover and the employers to keep them engaged during the course of managing the claim.
    • Working with employers to increase their awareness of actions to take to prevent further claims.
    • Ensuring all services are conducted in accordance with the model litigant rules and WorkCover’s customer principles.
  • Contributing to knowledge sharing with WorkCover and other providers through channels including Yammer, webinars, and focus groups to help WorkCover resolve specific issues related to common law claims.
  • Innovation and partnering to assist WorkCover to meet its objectives.
  • Optional provision of ad-hoc corporate legal services at additional cost.

The geographical scope of services delivery will include Brisbane and Queensland regional areas.

In establishing the new SOA WorkCover will be seeking interest from Providers currently providing services in the personal injury insurance market and from Providers who have the capability to enter this market.

WorkCover receives about 85,000-90,000 statutory claim registrations per annum and of these approximately 65,000 statutory claims are accepted per annum. These statutory claims are managed in-house by WorkCover. Approximately 3-4% of these claims transition to common law claims, producing about 3,000+ common law claims per annum.

Estimated spend under contract for this procurement is up to approximately $50 Million per year.
